For Buyer: Notes for buying



01 Inspection

 

On-site inspection.

Before buying a property, make sure to thoroughly check the property you are going to buy.

 

In Indonesia, it is the buyer's responsibility to check the property they are going to buy, because in most cases the seller is not responsible after the handover of the property, so it is important to thoroughly check anything in doubt before buying.

 




02 Investigation

 

Property Servey.

The buyer has an obligation to investigate the property he is going to buy.

 

Please note that the buyer cannot hold the seller responsible after the property is handed over to the buyer. In the transaction, do not rely solely on the seller's report. If necessary, contact a specialist before buying the property to thoroughly investigate the owner's information, building conditions, land conditions, surrounding areas, legal restrictions, etc. before making further considerations.

 


03 MOU

 

Understanding about MOU.

Once a thorough investigation of the property and negotiations regarding the terms have been completed and there are no issues, a memorandum of understanding (MOU) will be drawn up, detailing the terms of the contract, payment method, handover date, etc.

 


04 Investigation

 

The notary investigates the rights holder and coordinates with the BPN (National Land Agency).

Notaries play an important role in the property buying and selling process.

 

Notaries are authorized to make a Deed of Sale and Purchase Agreement (PPJB) and a Deed of Sale and Purchase / Letter of Transfer of Rights (AJB / SPH) and sign documents that have been prepared together with the buyer and seller.

 

Before making a deed of property sale and purchase agreement, the buyer can ask for help from a notary to confirm the validity of the seller's rights holder and if necessary, start coordinating with the National Land Agency, such as confirming land boundaries.

 


05 Contract


Preparation of property purchase and sale contracts.

The deed of sale and purchase of property is prepared by a notary and signed by the buyer and seller.

 

The buyer also pays a down payment in the amount specified in the contract.

 


06 Tax

 

Payment of land transfer tax and land acquisition tax.

Both buyers and sellers must pay taxes before the rights to the real estate that has been sold can be transferred.

The buyer is required to pay real estate acquisition tax, while the seller must pay real estate transfer tax. The process of signing the deed of transfer of rights will be carried out by a notary if the seller and buyer have paid the tax.

Since taxes must be paid before the real estate payment is made in full, it is important to thoroughly discuss the amount of the down payment when agreeing to the sales contract, depending on the seller's financial condition.

 


07 Settlement

 

Payment of the remaining agreed price.

The buyer pays the seller the remainder of the purchase price minus the down payment.

 


08 AJB/SPH

 

Deed of Sale and Purchase / Letter of Transfer of Rights (AJB/SPH).

The notary will prepare the deed of sale and purchase, the buyer and seller will sign the deed after the tax is paid. The deed of sale and purchase will be legally valid if it has been signed by a notary.

 


09 Holder Convertion


After the property sale and purchase deed is signed, the buyer can visit the National Land Office and complete the procedure for transferring the rights to the land that has been purchased.

 

Generally, the process of transferring ownership of land is completed within 2-3 months.
